1. Agreement to These Terms

These Terms & Conditions ("Terms") govern your use of Aiva, an AI voice-assistant app built and operated by Kuku Technologies Limited ("we", "us", "our"). By tapping Get Started, creating an account, or using Aiva in any way, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app.

2. What Aiva Does

Aiva is a call-answering assistant. You register up to three conditional call-forwarding rules with your telecom carrier, pointing calls you decline, let ring out, or can't take toward our voice AI. When that happens, our AI agent answers on your behalf, tells the caller it's an AI, asks why they're calling, applies any standing instruction you've set for that type of caller, and takes a message. We then send you a notification and a summary. Aiva does not screen or block calls before they ring, never reads your call log, and does not record or store call audio — only text transcripts and summaries. While the assistant is on a call, the app can also show you a read-only live transcript of it. If you turn on Read Contacts, the app looks a caller's number up on your phone so it can show their saved name; that check happens on your device and nothing about your contacts reaches us.

3. Eligibility

You must be at least 18 years old, hold an active Indian mobile number capable of conditional call forwarding, and have the legal right to register that number with Aiva. Aiva is designed for use within India's telecom network.

4. Your Account

You sign in with your phone number via OTP verification. You're responsible for keeping access to that number secure — anyone who can receive your OTP can access your Aiva account. Tell us immediately if you lose access to your number or suspect unauthorised use.

5. Setting Up Call Forwarding

During setup, Aiva dials carrier codes on your behalf to register three conditional forwarding rules (busy, no answer, unreachable) toward our number. Turning a rule off, or deleting your account, clears only the forwarding we set up — it never touches any unconditional forwarding you configured yourself. Carrier support for these codes varies, and Aiva can't guarantee every call will be forwarded successfully; we monitor forwarding health and will tell you if something looks broken.

6. How the AI Handles a Call

Our voice agent runs on a third-party conversational-AI platform. It always tells the caller, out loud and up front, that they're speaking with an AI. It can apply one pre-set instruction for the caller's category, chosen from a fixed list in the app — it can't be talked into anything outside that list, and it never makes commitments, promises, or decisions on your behalf. While the call is in progress you may see a read-only live transcript in a notification, an on-screen overlay, or the app, but there's no way for you to listen in, join, take over, or send a reply during the call itself.

7. Standing Instructions

You can choose a preset action and add an optional typed instruction within Aiva's fixed caller categories. Typed instructions are treated as preferences and cannot change Aiva's safety rules. The voice assistant can only choose from the fixed presets.

8. Notifications

We notify you about handled calls, and about a call in progress, by push notification. Delivery of any single notification isn't guaranteed — treat the in-app call list as the source of truth.

9. Acceptable Use

Don't use Aiva to harass, impersonate, defraud, or evade legitimate contact from anyone, and don't attempt to make the assistant say something false, illegal, or designed to deceive a caller about who or what they're speaking to. We may suspend or terminate accounts that misuse the service.

10. Service Changes & Availability

Aiva is an evolving product. We may add, change, or remove features, and availability depends on infrastructure we don't fully control end-to-end — our telecom, cloud, and AI vendors. We'll try to tell you about changes that affect how the assistant behaves.

11. Third-Party Services

Aiva relies on third-party providers for voice AI, telephony, cloud hosting and authentication, and payments (Razorpay and Google Play). Your use of Aiva is also subject to how those providers process data in the course of delivering a call — see our Privacy Policy for details.

12. Disclaimers & Limitation of Liability

Aiva is provided "as is." We don't guarantee that every call will be forwarded, answered, transcribed, or notified correctly — telecom, cloud, and AI systems all have failure modes outside our control. To the maximum extent the law allows, Kuku Technologies Limited isn't liable for missed calls, missed messages, or decisions the AI made on a caller's behalf within the instructions you set.

13. Termination

You can stop using Aiva at any time by turning off forwarding in Settings or deleting your account, which clears the forwarding rules we registered and removes your data as described in the Privacy Policy. We may suspend accounts that violate these Terms.

14. Governing Law

These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.

15. Changes to These Terms

We may update these Terms as Aiva changes. We'll update the "Last updated" date above, and for material changes, we'll tell you in the app before they take effect.
